iDEAL specific contractual obligations for Ogone Collect with Ingenico Financial Solutions

The merchant agrees explicitly that the guaranteed payments by the acquiring bank of the funds regarding iDEAL transaction is done to Ingenico Financial Solutions.

The merchant agrees to cooperate with all information request of Currence iDEAL B.V. in the context of following the Rules & Regulations of iDEAL.

The merchant works in accordance to all laws and regulations in place for his online activity.

The merchant has a documented complaints procedure with escalation that includes a working telephone number and/or email address.

Ingenico Financial Solutions notifies the merchant with this document that he can insure himself against payout risks concerning the funds he needs to receive.

Ingenico Financial Solutions will take all measures necessary at request of Currence BV or the Acquiring Bank against the merchant in case of (alleged) fraude.

Conditions regarding the use of the iDEAL logo and branding will happen in accordance to the rules of the brand owner, Currence BV.

Agreements regarding the payouts of the funds due are mentioned on the Collecting Contract.

If the merchant uses a third party, this third party will need to conform itself to the “Merchant integratiegids” and need to be mentioned in the agreement between the both parties. The merchant will enforce these rules at the third party by request of Ingenico Financial Solutions or Currence BV.

Liability issues are covered in the general terms and conditions of Ingenico Financial Solutions.

Ingenico Financial Solutions will do everything in it’s power to minimise service interruptions. In case an interruption has an impact on the customer, the customer will be notified by email using the contact info on the collecting contract.

In case of complaints or disputed, the merchant needs to contact the Ingenico Financial Solutions Compliance officer who will coordinate the procedure.

The jurisdiction and applied laws is stipulated in the general terms and conditions of Ingenico Financial Solutions.

iDEAL Bepalingen Ogone Collect met Ingenico Financial Solutions

De acceptant stemt er expliciet mee in dat de gegarandeerde uitbetaling door de Acquiring Bank van tegoeden van iDEAL transacties geschiedt aan Ingenico Financial Solutions.

De acceptant dient mee te werken aan informatieverzoeken van Currence iDEAL B.V. in het kader van de naleving van de Rules & Regulations iDEAL.

De acceptant dient te voldoen aan alle relevante regelgeving voor zijn on-line activiteiten.

De acceptant dient te beschikken over een gedocumenteerde klachten en escalatie procedure, waarbij ere en duidelijk contactpunt via telefoon en/of email voor de consumenten is.

Ingenico Financial Solutions laat weten dat de acceptant zich kan verzekeren tegen het terugbetaling risico met betrekking tot het ontvangen van tegoeden.

Ingenico Financial Solutions zal in opdracht van Currence BV of de Acquiring Bank de gevraagde stappen ondernemen en noodmaatregelen treffen ten aanzien van de acceptant in geval van (vermeende) fraude.

Voorwaarden omtrent het gebruik van het iDEAL logo en alle andere branding waarvan Currence eigenaar is zal volgens de regels van de merkeigenaar verlopen.

Afspraken omtrent de uitbetaling staan vermeld in het Collecting contract.

Indien de Acceptant een derde partij inschakelt dient deze derde partij zich te houden aan de bepalingen in de Merchant Integratiegids en dient de Acceptant dit ook te bepalen in de overeenkomst met de derde partij. De Acceptant zal dit ook
onmiddellijk afdwingen bij de derde partij op verzoek van Ingenico Financial Solutions.

Verdeling van de aansprakelijkheid is vermeld in de algemene voorwaarden van Ingenico Financial Solutions.

Ingenico Financial Solutions zal er alles aan doen om storingen te minimaliseren.

Ingeval de storing een impact zou hebben, zal de klant op de hoogte gebracht worden via email met de contactgegevens in het collecting contract vermeld.

Ingeval klachten of geschillen van de acceptant kan die contact opnemen met de Compliance Officer van Ingenico Financial Solutions die de klacht zal coördineren.

Het van toepassing zijnde recht is bepaald in de Algemene Voorwaarden van Ingenico Financial Solutions.
